New Jersey Should Approach Health Insurance Exchanges ...

We, in the state of New Jersey under the leadership of Governor Christie, continue to implement provisions of health reform law as deemed appropriate to improving the health of the people of New Jersey. One such provision is creating a health insurance exchange, which is a marketplace for individuals and small businesses to buy state-approved insurance policies. The goal is for these exchanges to provide individuals and small businesses with a ?one-stop shop? to find and compare affordable, quality private health insurance options. Currently the federal law requires that each state have an exchange, offering the opportunity for states to create their own, providing subsidized insurance options for individuals up to a FPL of 400%. We estimate a minimum of 500,000 New Jerseyans buying insurance through the exchange, with a potential of 150,000 people transitioning from the employer sponsored health plan coverage to the insurance exchange. The administration has been evaluating this, seeking input from community and industry stakeholders, and last month was awarded $7.67 million in Level One exchange grants from HHS. In addition, last week the legislature passed a bill that would create a health insurance exchange in the Garden State in anticipation of full implementation of the Patient Protection and Affordable Care Act with key components that include an active exchange, a governance structure and a basic health plan or ?optional Medicaid expansion?.

As we decipher our current environment, it is important for us to recognize that there are some factors affecting our position and decision in the state. Firstly, our state already has two ?mini-exchanges?- the Individual Health Coverage Program Board and the Small Employer Health Benefits Program Board. Both are ?in but not of? the Department of Banking and Insurance. We will have to develop rules that will help the integration and interaction of these exchanges with the state-wide exchange. Secondly, creating a new system to administer the federal requirement will be costly and time-consuming, so we will have to identify ways to make the process effective and efficient. Although the federal government will pay for exchange start up, state exchanges will have to fund their own administrative costs starting in 2015. Our state is still working with actuaries to estimate the cost, but Rhode Island received the first Level Two Exchange Establishment grant in November 2011, of $58.5 million to fund the development, design, and technology procurement of the Exchange through December 2014. Another aspect to consider is whether the state should set up a ?passive? exchange, which simply acts as a clearinghouse, or an ?active? one that would allow the exchange to be the purchaser and negotiate its rates. While we assess this, it is important to recognize that the active approach will require significant resource allocation, and the possibility of duplication and redundancy of governmental and regulatory functions. Finally, The United States Supreme Court will later this month, consider a lawsuit challenging the federal law that requires the mandate with a decision widely expected to be issued by the end of June.

The clock on that deadline is not as close to midnight as initially interpreted to avoid a federally operated health insurance exchange in our state. With all these confounding variables in this current environment, the Governor should approach the next steps in creating the state health exchange carefully. Most importantly, waiting to see the U.S. Supreme Court ruling in June, before seeking the additional grants that New Jersey will continue to be eligible for until the end of 2014. If the lawsuit to overturn the PPACA is successful, then the governor?s administration would have wasted valuable resources building a program that will not be put into place.

As a physician, previous health insurance executive and the former commissioner of health, I know that our collective goal remains to ensure access to high quality healthcare to all New Jerseyans. The state including the policy makers, legislators and the Governor should carefully assess and evaluate all these factors before intuitively reacting and embarking on an effort that may be futile. While waiting for the Supreme Court decision, we should continue our due diligence on creating the best state operated health insurance exchange for our state, which is void of bureaucracy, administrative duplication and red tape. Having worked personally with many of the stakeholders in this domain, I am confident that we will continue to have these healthy debates, while finally reaching consensus on the best approach for our collective New Jerseyan community.

Images capture split personality of dense suspensions

ScienceDaily (Mar. 30, 2012) ? Stir lots of small particles into water, and the resulting thick mixture appears highly viscous. When this dense suspension slips through a nozzle and forms a droplet, however, its behavior momentarily reveals a decidedly non-viscous side. University of Chicago physicists recorded this surprising behavior in laboratory experiments using high-speed photography, which can capture action taking place in one hundred-thousandths of a second or less.

UChicago graduate student Marc Miskin and Heinrich Jaeger, the William J. Friedman and Alicia Townsend Friedman Professor in Physics, expected that the dense suspensions in their experiments would behave strictly like viscous liquids, which tend to flow less freely than non-viscous liquids. Viscosity certainly does matter as the particle-laden liquid begins to exit the nozzle, but not at the moment where the drop's thinning neck breaks in two.

New behavior appears to arise from feedback between the tendencies of the liquid and what the particles within the liquid can allow. "While the liquid deforms and becomes thinner and thinner at a certain spot, the particles also have to move with that liquid. They are trapped inside the liquid," Jaeger explained. As deformation continues, the particles get in each other's way.

"Oil, honey, also would form a long thread, and this thread would become thinner and break in a way characteristic of a viscous liquid," Jaeger said. "The particles in a dense suspension conspire to interact with the liquid in a way that, when it's all said and done, a neck forms that shows signs of a split personality: It thins in a non-viscous fashion, like water, all the while exhibiting a shape more resembling that of its viscous cousins."

It took Miskin and Jaeger six months to become convinced that the viscosity of the suspending liquid was a minor player in their experiments. "It is a somewhat heretical view that this viscosity should not matter," Jaeger said. "Who would have thought that?"

Miskin and Jaeger presented their results in the March 5 online early edition and the March 20 print edition of the Proceedings of the National Academy of Sciences.

In their experiments, Miskin and Jaeger compared a variety of pure liquids to mixtures in which particles occupy more than half the volume.

"The results indicate that what we know about drop breakup from pure liquids does not allow us to predict phenomena observed in their experiments," said Jeffrey Morris, professor of chemical engineering at City College of New York. "The most striking and interesting result is the fact that, despite these being very viscous mixtures, the viscosity plays little role in the way a drop forms."

Few studies have examined droplet formation in dense suspensions. As Morris noted, such work could greatly impact applications such as inkjet printing, combustion of slurries involving coal in oil, and the drop-by-drop deposition of cells in DNA microarrays.

Scientific defiance

In these applications particles often are so densely packed that their behavior defies a simple scientific description, one that might only take into account average particle size and the fraction of the liquid that the particles occupy, Morris explained. The UChicago study showed that particles cause deformations and often protrude through the liquid, rendering any such description incomplete until fundamental questions about the interface between a liquid mixture and its surroundings are properly addressed.

"Miskin and Jaeger provide arguments for the importance of these protrusions in their work and suggest that the issue is of broader relevance to any flow where a particle-laden liquid has an interface with another fluid," Morris said.

Miskin and Jaeger verified their results by systematically evaluating different viscosities, particle sizes and suspending liquids, and developed a mathematical model to explain how the droplet necks evolve over time until they break apart.

One initially counter-intuitive prediction of this model was that larger particles should produce behavior resembling that in pure water without any particles. "If you want to make it behave more like a pure non-viscous liquid, you want to make the particles large," said Jaeger, who finds himself intrigued by nature's seemingly endless store of surprises.

Miskin and Jaeger indeed observed this when the particle size approached a significant fraction of the nozzle diameter, making the particles visible to the naked eye.

"You think you have a pretty good idea of what should happen, and instead there's a surprise at every corner. Honestly, finding surprises is what I love about this work," Jaeger said.

Genes for learning, remembering and forgetting

ScienceDaily (Mar. 29, 2012) ? Certain genes and proteins that promote growth and development of embryos also play a surprising role in sending chemical signals that help adults learn, remember, forget and perhaps become addicted, University of Utah biologists have discovered.

"We found that these molecules and signaling pathways [named Wnt] do not retire after development of the organism, but have a new and surprising role in the adult. They are called back to action to change the properties of the nervous system in response to experience," says biology Professor Andres Villu Maricq, senior author of the new study in the March 30 issue of the journal Cell.

The study was performed in C. elegans -- the millimeter-long roundworm or nematode -- which has a nervous system that serves as a model for those of vertebrate animals, including humans.

Because other Wnt pathways in worms are known to work in humans too, the researchers believe that Wnt genes, the Wnt proteins they produce and so-called "Wnt signaling" also are involved in human learning, memory and forgetting.

"Almost certainly what we have discovered is going on in our brain as well," Maricq says. And because a worm nerve-signal "receptor" in the study is analogous to a human nicotine receptor involved in addiction, schizophrenia and some other mental disorders, some of the genes identified in the worm study "represent possible new targets for treatment of schizophrenia and perhaps addiction," he adds.

Wnt genes and their proteins already were known to "pattern the development and distribution of organs in the body" during embryo development, and to be responsible for various cancers and developmental defects when mutated, he says.

Maricq conducted the study with these Utah biologists: doctoral students Michael Jensen and Dane Maxfield; postdoctoral researchers Michael M. Francis, Frederic Hoerndli and Rui Wang; undergraduate Erica Johnson; Penelope Brockie, a research associate professor; and David M. Madsen, a senior research specialist.

Synapse Plasticity is the Basis of Learning and Memory

Synapses are the connections between nerve cells (neurons). Nerve signals are transmitted through synapses. Learning and memory concern how these connections are made, broken, strengthened or weakened. Proteins known as receptors are delivered to the synapses or removed from them to strengthen or weaken the connection.

In the new study, Maricq and colleagues identified a "Wnt signaling pathway" -- a series of genes and the proteins they produce -- that controls the strength of nerve signal transmission from one neuron through a synapse to the next neuron. This allows "plasticity" of synapses -- a key factor in learning, retaining memories and forgetting.

"The adult nervous system is not a stagnant tissue, but rather dynamic and plastic, with the strength of synapses -- specialized neuron-to-neuron connections -- changing with experience, learning and memory," Maricq says. "It's not a fixed thing, like when you're done making the heart, you're done."

When synapses and thus incoming nerve signals are strengthened by adding receptors, an organism learns and remembers; when the opposite occurs, the organism forgets, he adds.

How is that connection strengthened or weakened? When one neuron sends a nerve signal to another neuron, the first neuron releases a chemical known as a neurotransmitter, which moves through the synapse connecting the two cells and attaches or binds to receptors on the surface of the second neuron.

"You can think of the receptors like amplifiers, like hearing aids," Maricq says.

The volume of the received nerve signal depends on the number of receptors, which are stored in a supply depot just below the nerve cell's surface.

The Wnt signaling identified in the new study "tells the depot to put more receptors into the synapse -- or not," says Maricq.

He emphasizes that the Wnt chemical signal is different than the actual nerve signal carried by a neurotransmitter chemical, which in the new study was acetylcholine. The Wnt signal "is a secondary signal that controls the volume of the neurotransmitter signal," Maricq says.

Worms Reveal Details of Nerve Signal Volume Control

By crippling various genes in the worms, the researchers identified the "signaling pathway" by which a Wnt protein in one nerve cell sends a chemical signal to another cell telling it to increase the number of receptors on its surface, thus increasing the strength or volume of nerve signals between the cells.

The type of nerve-signal receptor in the study is an acetylcholine receptor named ACR-16. When researchers crippled the gene that makes the ACR-16 receptor protein, there were not enough receptors, so nerve signals were disrupted and the worms "had uncoordinated movement," Maricq says. "They were semi-paralyzed."

The scientists found mutations of other genes that also resulted in inadequate ACR-16 receptors and impaired the worms' movement. They discovered such genes belong to the "Wnt signaling pathway" that puts enough receptors on the cell surface so signals can be received.

Besides ACR-16, genes in that pathway produced proteins named CWN-2 -- which is a Wnt protein -- LIN-17, CAM-1 and DSH-1.

Here is how that pathway controls the volume of incoming nerve signals:

1. A neuron releases CWN-2, which binds onto a receptor protein on the signal-receiving cell. That protein is a newly discovered combination of the LIN-17 and CAM-1 proteins.

2. The LIN-17/CAM-1 protein sends a signal to a protein called disheveled, or DSH-1.

3. "DSH-1 somehow sends the volume-control signal" that dispatches more ACR-16 receptors from depots inside the second neuron to that cell's surface, thus boosting the volume of the received nerve signal, Maricq says.

The researchers used a green jellyfish protein to mark the ACR-16 receptors so they were visible under a microscope. When any of the genes in the Wnt signaling pathway were mutant, the scientists could see the green-labeled receptors accumulate under the surfaces of nerve cells instead of moving to the surface.

Another experiment recorded electrical currents in worm nerve synapses and found it was smaller when any of the Wnt pathway genes were mutated. The smaller current -- reflecting impaired nerve-signal transmission -- explains why the mutant worms were partially paralyzed.

Human Version of Worm Receptor Tied to Mental Disorders

The ACR-16 acetylcholine receptor is the worm version of the alpha-7 nicotinic acetylcholine receptor in humans and other vertebrates. Both are similar in structure and function in animals from worms to fruit flies, mice and people.

The alpha-7 receptor "is important in schizophrenia and a number of different mental disorders, and may have a role in addiction, but we don't understand how it's regulated," Maricq says.

Many existing psychiatric drugs modify synapse strength. The new study suggests research should be done to show if the same Wnt signaling genes in worms also control alpha-7 receptor levels on human brain cells. If so, new drugs might be developed to target those genes as a way to treat mental disorders, including addiction.

"Addiction is like learning at a primitive level," Maricq says. "Addiction means that somewhere in your brain, synapses are too strong. So you want more."

The study was funded by the National Institutes of Health and the American Heart Association.

Special Delivery picks up two years after book one, Deliver Me From Evil, ends, and continues with the stories of Mara and Lawan, as well as others carried over from book one. Mara hopes she is finally free to pursue her own life because she was rescued from the brothel and her testimony helped lock up her uncle for life. But the man has underground connections and is driven by revenge to reach out from behind bars and deliver the ultimate punishment to his niece.

This isn?t the first fiction series you?ve written on nationwide and even worldwide social issues, the one previous to this being the persecuted Church. What draws you to these difficult topics?

As a Christian, I believe I am compelled to use my God-given gifts to honor God in all I do?and that includes exposing the deeds of darkness, calling sinners to repentance, and taking a stand for righteousness by doing all I can to help rescue those who are suffering. I dare not turn my back on ?the least of these.? I also believe that God placed this sort of burden on my heart even before I became a Christian at the age of 26. I?ve always been a champion of the underdog, a ?soap-box? preacher, if you will. When I met Jesus, I simply redirected that passion toward His people, realizing I couldn?t effect real change in my own strength anyway.

With your obvious passion to right social and moral wrongs through the power of the Gospel, how did writing and speaking enter into that?

I?ve known I wanted to be a writer since I was a child?never wanted to do anything else. When I was a teenager I told my then boyfriend (now husband) that I was going to be a writer one day. What a blessing that God allowed me to fulfill that dream! After becoming a believer and growing in my faith, it was natural to take my passion to fight for others and incorporate it into my writing. Speaking, on the other hand, was an entirely different story. I was terrified of public speaking when I was young, and the day I received Christ I made a ?bargain? with God, promising to do anything He asked of me?so long as it didn?t include public speaking. (Does God have a sense of humor or what???) Now, when I stand in front of audiences where I believe God has called me to speak (and actually find myself enjoying it!), I tell my listeners that if God has called them to do something and they feel it?s impossible, they can consider me their ?visual aid? that NOTHING is impossible with God IF we will simply take that first step of obedience and let Him fulfill His purpose in and through us.

With the topics of the worldwide persecuted Church and human trafficking under your belt, what other issues are you dealing with in your writing?

My Christmas 2011 book, A Christmas Journey Home, dealt with the immigration/border problem, and my Christmas 2012 novel, Unexpected Christmas Hero, will be about homelessness in America. The next issues-related fiction series I have on tap?which I am just starting to write, by the way?is called the ?Patches of Courage? series and will begin releasing in late January 2013. Book one is The Moses Quilt, based on the life of Harriet Tubman, and will be followed by The Christmas Quilt and The Impossible Quilt. This series of books will highlight historical American women whose Christian faith enabled them to walk in great courage and make a difference in the lives of countless people.

Special Delivery is the story of Mara, who is now free from sex slavery.? It is the story of her life.? Yet it?s more than just her life.? It?s the suspense of revenge from Jefe.? It?s the opportunity to help other girls get free.? Will Mara find the grace to work through her personal issues and reach forth and help?

A Willful Misunderstanding of the Anti-Protest Law - Legal As She Is ...

Earlier this month President Obama signed H.R. 347 into law despite vigorous opposition from free speech activists. This ?anti-Protest? law threatens serious punishment (up to one year in federal prison) for those who ? in the police?s determination ? cross the blurry line between peaceful protest and disorderly conduct in or around areas closed off by the Secret Service.

And where do activists typically want to protest? As close as possible to important policymakers like the President, Vice President, presidential candidates and foreign heads of state ? all of whom are entitled to Secret Service protection under federal law.

These restrictions are not new. H.R. 347 amends an existing federal law that made it a crime to ?willfully and knowingly? enter, block or be disorderly in or around public areas which have been closed off by the Secret Service. H.R. 347 removed the word ?willfully,? so that demonstrators need to only ?knowingly? violate the law.

The media and politicians alike were quick to point out what a difference the deletion of a single word makes. The Wall Street Journal Law Blog specifically noted the ?difference one word can make.? Meanwhile, Rep. Justin Amash (R-Michigan) wrote on his Facebook wall that removing ?willfully? made protesting a crime ?even if the person does not know it?s illegal to be in that area.? And Fox News political and legal analyst Judge Andrew Napolitano wrote that with the word ?willfully? gone, ?a person accidentally in a restricted area can be charged and prosecuted, as well.?

They?re wrong. Even though H.R. 347 is a blatant violation of Americans? right to protest, it has nothing whatsoever to do with the word ?willfully.? ?

In a nutshell, in order to be convicted of the vast majority of crimes a person must act with a certain criminal state of mind, or mens rea. ?The Model Penal Code (MPC), an influential guide the individual states and the federal government use as model for their criminal laws, recommends that criminal codes use four different levels of mens rea: purposefully, knowingly, recklessly, and negligently. Notably, the term ?willfully? is absent.

The use of ?willfully? as a criminal state of mind is a remnant of criminal codes developed prior to legal experts? ? like the drafters of the MPC ? efforts to provide clear uniform standards for the application of criminal law. Over time, courts have interpreted ?willfully? in a variety of different ways, leading to confusion today about what it really means. Referring to the use of the word ?willfully? in criminal law, Judge Learned Hand once said it is ?an awful word! It is one of the most troublesome words in a statute that I know. If I were to have the index purged, ?willful? would lead all the rest in spite of its being at the end of the alphabet.?

The drafters of the MPC offered the following instruction for perplexed judges around the country dealing with criminal codes that still contain the worrisome word: ?A requirement that an offense be committed willfully is satisfied if a person acts knowingly with respect to the material elements of the offense, unless a purpose to impose further requirements appears.? In other words, ?willfully? and ?knowingly? have nearly identical meanings.

The difference between ?willingly? and ?knowing? was set out in the 1998 Supreme Court decision Bryan v. United States, which held that in order to act ?willfully,? a person must know his conduct is unlawful. On the other hand, the mental state ?knowingly? requires only that a person is aware of the factual events that led to the crime.

But while this may seem like a significant difference, it isn?t. Not at all.

For example, protesters prosecuted under the old law, with the magic ?willfully?present, could not honestly have claimed that they had no idea that trespassing or disorderly conduct was illegal. Such a claim would have been laughed out of court.

The ?knowing? element of the new H.R. 347 ? all by itself ? requires the government to prove that a person was actually aware he was (1) entering, blocking or being disorderly and (2) in or around a restricted area. This means that those who were unaware that they crossed into a restricted area or accidently blocked the entrance of a restricted building could not be charged under the law.

Through his communications director, Rep. Thomas Rooney (R-Florida) defended H.R. 347 by saying, ?right now it?s not a federal violation to jump the fence and run across the White House lawn, this bill makes it a federal violation.? This is the only aspect of the law that was substantively expanded, and so on this score, Rep. Rooney is right because prior to the new law, it was not a federal crime to trespass on the White House lawn if the President or his family was not inside

But Rep. Rooney went on to say that the new law ?doesn?t affect anyone?s right to protest anywhere at any time. Ever.?

And this couldn?t be more wrong.

H.R. 347 violates protesters? first amendment right to protest in their preferred public place.

In 1968, the Supreme Court decided United States v. O?Brien, the seminal case for scrutinizing government restrictions on symbolic expression. The Vietnam War was raging, and Mr. O?Brien burned his draft card in violation of federal law. The Court held that the government was justified in punishing him because the law was aimed at preserving information on the draft cards that was necessary for keeping track of draftees, and only incidentally interfered with Mr. O?Brien?s preferred symbolic expression.

The right to protest outside the White House or other places where Secret Service-protected individuals are located is symbolic expression in the same way that Mr. O?Brien?s burning of his draft card is. But while the ban on burning draft cards had a clear purpose in addition and unrelated to suppressing speech, the ban on protest in H.R. 347 does not.

Proponents of H.R. 347 claim it advances the government?s interest in protecting its property from damage and its officials from intruders. But every state?s laws already criminalize trespass, disorderly conduct and criminal mischief.

For example, jumping the White House?s fence would be a violation of the District of Columbia?s trespass statute, which subjects jumpers to up to six months in jail. Since police can arrest and remove anyone in violation of this state law, the government doesn?t need H.R. 347 in order to protect its property from damage and its officials from intruders.

And, the practical consequence of H.R. 347?s more serious punishment is that it will deter activists from staging protests near important policymakers.

The impact on protest locations is not incidental. The law was purposefully constructed to shield a select group of powerful government officials from provocative protests. A law which restricts speech based on the impact of its message is a fundamental violation of the first amendment.

It is no coincidence that Congress is polishing up the tools in the government?s arsenal for prosecuting protesters now. Later this year, the G-8 summit and the Democratic and Republican national conventions will draw massive protests. Because the President, Vice President, presidential candidates, or foreign heads of state will be in attendance at these events, activists will be at risk for violating federal law when protesting at them.

If protesters are convicted under the law, you can be sure that they will challenge their convictions on first amendment grounds. And if they do, I?ll bet that you won?t hear a word about the law?s lack of the word ?willfully.?
